FURNIBLE – Product Warranty Agreement

This Product Warranty Agreement is made and entered into as of May 3, 2025, by and between FURNIBLE and the original purchaser, Khaled Mohsen Khawar, of FURNIBLE products (hereinafter referred to as the "Purchaser").

1. Products Covered This Agreement applies to all furniture products manufactured and sold by FURNIBLE (hereinafter referred to as the "Products").
2. Warranty Period FURNIBLE warrants to the original Purchaser that the Products will be free from defects in material and workmanship for a period of five (5) years from the date of delivery of the Products to the Purchaser.  
3. Warranty Coverage This warranty covers defects in materials and workmanship under normal domestic use for the Warranty Period.
3.1 Defects in Materials: This warranty covers defects in the materials used to manufacture the Products, including, but not limited to, wood, metal, fabric, and other components, provided such defects are not a result of normal wear and tear or external factors.
3.2 Defects in Workmanship: This warranty covers defects resulting from the manufacturing process, including but not limited to, joinery, assembly, and finishing.
3.3 Domestic Use: This warranty applies exclusively to Products used for normal residential, non-commercial purposes.
3.4 Original Purchaser: This warranty is for the sole benefit of the original purchaser and is non-transferable.
4. Products Not Covered This warranty does not cover the following:
Normal wear and tear, including but not limited to, fading, pilling, and softening of cushions over time. Damage caused by misuse, abuse, neglect, or accidents. Damage caused by improper assembly, installation, handling, or maintenance not in accordance with FURNIBLE's instructions. Damage caused by exposure to extreme environmental conditions, including but not limited to, direct sunlight, humidity, temperature fluctuations, or moisture. Damage caused by alterations or modifications made to the Products by the Purchaser or a third party. Damage resulting from improper cleaning methods or products. Products used for commercial, institutional, or rental purposes. Consequential or incidental damages. Variations in wood grain, color, or texture, which are considered natural characteristics.

5. Purchaser's Responsibilities To obtain warranty service, the Purchaser must:
Provide the original receipt or equivalent proof of purchase. Notify FURNIBLE of the alleged defect promptly and within the Warranty Period. Provide a detailed description and photographic evidence (if requested) of the defect. Cooperate with FURNIBLE or its authorized representative to allow for inspection of the Product.
6. FURNIBLE's Options If a Product is determined by FURNIBLE, in its sole discretion, to be defective under this warranty, FURNIBLE will, at its option, either:
Repair the defective Product. Replace the defective Product with the same or a comparable product. Provide a refund of the original purchase price of the defective Product. FURNIBLE reserves the right to determine the most appropriate remedy. Any repair or replacement will not extend the original warranty period.
7. Limitation of Liability
7.1 The remedies provided in this Agreement are the Purchaser's sole and exclusive remedies for any breach of warranty.
7.2 FURNIBLE shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to, loss of use, lost profits, or business interruption, even if FURNIBLE has been advised of the possibility of such damages.
7.3 To the extent permitted by applicable law, FURNIBLE's total liability under this warranty shall not exceed the original purchase price paid for the defective Product.  
8. Warranty Claims Process To initiate a warranty claim, the Purchaser should contact FURNIBLE's customer service department through the contact information provided by FURNIBLE. The customer service representative will provide instructions on the necessary steps to process the claim.
9. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State or Province where the Purchaser is located, without regard to its conflict of laws principles.
10. Entire Agreement This Agreement constitutes the entire agreement between the parties concerning the warranty for the Products and supersedes all prior and contemporaneous agreements, understandings, and representations, whether oral or written, relating to the subject matter of this Agreement.  
11. Miscellaneous 11.1 Severability: If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
11.2 Waiver: No waiver of any provision of this Agreement shall be effective unless in writing and signed by the party against whom the waiver is sought to be enforced. A waiver of any breach shall not be deemed a waiver of any subsequent breach.
11.3 Amendments: Any amendments or modifications to this Agreement must be in writing and signed by both parties.  
12. 5-Year Guarantee Reaffirmation FURNIBLE reaffirms that all Products are guaranteed to maintain their quality and durability under normal domestic use for a period of five (5) years, as detailed in Sections 2 and 3 of this Agreement.
